Wouldn’t have thought twice other than your story kept changing. You said you could reproduce the problem anytime you wanted yet you couldn’t prove it to the dealer soooo in advance, here ya go

eventually able to force them to buy it back. And nothing will ever convince him to buy another Beemer..

I had the same thing with a Jeep (Fiat) I won’t buy another until someone fixes Fiats mess. One bought back and the replacement was junk
